TURCANA TOURS
TERMS AND CONDITIONS
1. INTRODUCTION
These Terms and Conditions constitute a legally binding agreement between TURCANA TOURS and the Client. By booking any service (Transportation, Excursions, or related tourism services), whether through our website, electronic communication, or any other channel, the Client expressly agrees to be bound by these Terms and Conditions.
Booking confirmation constitutes full and irrevocable acceptance of these Terms.
2. DEFINITIONS
- “Company” refers to TURCANA TOURS.
- “Client” refers to the person making the reservation and all persons included in that reservation.
- “Services” refers to transfers, excursions, and tourism-related services offered by the Company.
- “No Show” refers to the Client’s failure to appear at the agreed time and location.
3. RESERVATIONS AND PAYMENT
3.1 Reservations are subject to availability and are not confirmed until written confirmation is issued by TURCANA TOURS.
3.2 Prices are quoted in U.S. Dollars (USD).
3.3 A minimum deposit of 30% may be required to confirm certain services.
3.4 Full payment must be completed before service commencement unless otherwise agreed.
3.5 TURCANA TOURS reserves the right to cancel reservations in cases of suspected fraud or chargeback risk.
4. CANCELLATION POLICY
4.1 Transfers and Excursions:
- 100% refund if cancellation is received at least 48 hours prior to service.
- No refunds for cancellations received less than 48 hours prior.
- No refunds for No Show.
4.2 Once a service has commenced, no refund shall apply.
4.3 Refunds, if applicable, will be processed to the original payment method within 10–15 business days, excluding bank processing delays.
5. NO SHOW POLICY
Failure to appear at the agreed pickup time and location shall be considered a No Show and shall result in 100% service charge.
For departure transfers, a maximum waiting time of 30 minutes applies unless otherwise agreed.
6. INDEPENDENT SERVICE PROVIDERS
TURCANA TOURS acts as an intermediary between Clients and independent third-party service providers.
The Company exercises due diligence in selecting providers but does not control their operations.
Accordingly, TURCANA TOURS shall not be liable for acts, omissions, negligence, or operational failures of independent suppliers.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the total liability of TURCANA TOURS for any claim shall not exceed the amount paid by the Client for the specific service giving rise to the claim.
The Company shall not be liable for indirect, incidental, consequential, or punitive damages.
8. FORCE MAJEURE
TURCANA TOURS shall not be liable for failure to perform due to events beyond reasonable control, including but not limited to:
- Natural disasters
- Weather conditions
- Government restrictions
- Airport delays
- Civil unrest
- Public health emergencies
- Acts of God
9. HEALTH AND SAFETY
Clients participate voluntarily in excursions and activities.
Certain activities may involve inherent risks.
By booking, Clients acknowledge and assume such risks.
Pregnant women and persons with medical conditions must consult a physician prior to participation.
The Company reserves the right to deny participation for safety reasons.
10. CHILDREN AND INFANTS
Infants: 0–23 months
Children: 2–11 years
Proof of age may be required.
Failure to comply with age requirements may result in rate adjustment.
11. CHARGEBACK AND PAYMENT DISPUTES
In case of unjustified chargebacks or fraudulent disputes, the Client agrees to reimburse all administrative, legal, and banking costs incurred by TURCANA TOURS.
12. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws of the Dominican Republic.
Any dispute shall be exclusively submitted to the competent courts of La Altagracia Province.
13. SEVERABILITY
If any provision is declared invalid, the remaining provisions shall remain in full force and effect.
14. ACCEPTANCE
By completing a reservation, the Client confirms that they have read, understood, and accepted these Terms and Conditions.
